ClickBank And Habeas Work To Keep Email Marketing Safe For Legitimate Marketers
BOISE, ID and PALO ALTO, CA - April 15, 2003. ClickBank, the on-line marketplace for downloadable e-books, software, and digitally delivered products, and Habeas, the company which fights spam with poetry and the law, announced today that ClickBank and Habeas will continue to work to help ensure that legitimate email marketing is not ruined by those who send unwanted junk email, sometimes known as “spam.”
Habeas allows the senders of legitimate email to demonstrate to receiving systems that their email is not spam, and should be delivered, by including a trademarked Habeas header in their outgoing email. Habeas recently filed a lawsuit against a ClickBank affiliate whom Habeas alleges was violating their trademark, naming ClickBank as one of three co-defendants. ClickBank has been dropped from this lawsuit.
“We are very pleased to announce this arrangement with ClickBank,” said Anne P. Mitchell, CEO of Habeas. “ClickBank was extremely responsive to our concerns about people abusing our system in order to push through unwanted email.”
“We do not tolerate spamming in any form, and anyone who promotes any of our programs or affiliate products through the use of spam will have their ClickBank account terminated,” said Geoffrey Hoyl, Chairman and CEO of ClickBank. “We understand Habeas' need to strictly police and pursue any misuse of their intellectual property.”
ClickBank represents over 150,000 vendors and affiliates selling more than 10,000 different products on-line. Habeas is deployed in outgoing email by more than 2,000 businesses, bulk mailers, ISPs, and individuals worldwide.
“ClickBank has been the model of responsibility,” said Mitchell. “It is important to understand that intellectual property law requires us to vigorously protect our trademark, and privacy concerns dictate that we provide legal authority under which someone may reveal their user's identity and other information. The fact that we named ClickBank in our lawsuit against their user should in no way be taken to mean that ClickBank was engaged in spamming.”
