If you ask me, I think it's immoral to persuade someone to purchase something with big promises, and then when it doesn't work for them, try to use legalities to avoid honoring your guarantee. Just because something is legal, doesn't mean it's right. (not that I'm saying Mr. Ducharme is doing anything legal or illegal..I'm no lawyer)
We've issued refunds to our customers even if they provide no explanation at all. To say that you guarnatee that the product is everything you say it is, and then to say that you will not issue a refund because it IS what you say it is... well, that IS rediculous. It's your opinion. What you're essentially saying is, "My opinion is correct. My product is everything I say it is, and your opinion does not matter."
Why offer a guarantee at all in such a case? Would you like to receive a waranty when you purchase a new car that says "We warrant that this car performs good for a long time."
You have to define "long time". They could easily say "Well, a long time to us is 10 minutes because the car is actually a piece of crap." Such trickery would not settle well with consumers... as obviously is also true in Mr. Ducharme's case.
I would have absolutely no problem with purchasing something without a guarantee and it didn't work. Why? Because I took that risk. However, if a product is sold with a gaurantee to eliminate the risk (in the buyer's mind), then I would be very angry if that guarnatee was not honored, even more so if the guarantee was only a trick and not a true guarantee.
I'm just responding to the email response that was posted in regards to someone's request for a refund. I've never done business with Mr. Ducharme and don't know him personally, but one can see from the email that was posted that he obviously has no problem keeping someones money if they are unsatisfied with the product.
